Bill Analysis

Under current law, public employers are required to provide a reasonable amount of break time for an employee to express breast milk as needed and provide a private place for the employee to express breast milk, other than a multiple user bathroom, that is shielded from view and free from intrusion from other employees and the public. A single user bathroom is permissible under current law.

HB 1041 would prohibit public employers from designating any bathroom as an acceptable place for an employee to express breast milk. 

Vote Recommendation Notes

Because this requirement relates to public employers and not private employers, Texas Action remains neutral on HB 1041.
