Relating to the procedure for obtaining a right to use state water if the applicant proposes an alternative source of water that is not state water.
Bill Analysis
Under current law, there are a series of procedures to secure a permit to use state water. SB 864 would include the identification of alternative water sources to be included in application for permits and notifications. This bill would also require a notice to be sent to a groundwater conservation district and published publicly for applications in which a permit is sought in connection to an exempt dam project with a well identified as an alternative water source, within the district the well is located.
