Bill Analysis

Under current law, a person is entitled to the recovery of expenses and attorney's fees in the case of a frivolous claim made by a state agency. SB 813 would also make the state culpable for damages and attorney's fees in the case of a frivolous regulatory action.

This bill supports the principle of limited government by holding the state legally accountable for damages and fees related to frivolous regulatory actions, which increases accountability. For this reason, we support SB 813.
