Relating to a landowner’s liability for injuries incurred during certain recreational use. 


Bill Analysis

This bill would expand the definition of “recreation” to include rock climbing in relation to the limited liability of landowners. Under current law the liability of landowners varies based on the degree on permission granted to someone who may become injured. 

Vote Recommendation Notes

This bill does not make any substantial changes. Arguably rock climbing is already included in the definition of recreation, under “any other activity associated with enjoying nature or the outdoors”. This bill protects landowners against frivolous lawsuits by individuals who knowingly accept risks related to use of another's property. Because this supports our principles of property rights, personal responsibility, and limited government, we support SB 658.
