Bill Analysis

Under current law, if there is a criminal action relating to allegedly stolen property the hearing will be held in the municipality in which the property was seized. If this bill passes, the venue for the hearing could be held in either the municipality in which the property was seized, or in the municipality in which the property was allegedly stolen. 

Vote Recommendation Notes

This bill would allow for greater flexibility regarding where to hold a hearing related to the recovery of stolen property. This bill upholds our commitment to private property rights and individual liberty by creating an opportunity for a venue change so that victims of theft would not have to incur the costs of traveling, food, and lodging during the hearing. We support SB 631.
