Relating to authorizing an exemption for open-enrollment charter schools from certain municipal drainage requirements.

Bill Analysis

Under current law, the state, a county, municipality, or school district may be exempted from water drainage regulations. SB 601 would add open-enrollment charter schools to the list of entities permitted for exemption. In addition, this bill would require that school districts and charter schools be treated equally with respect to exemption from drainage requirements.

Vote Recommendation Notes

Though it is well within the authority of the state to supersede local regulations for its own properties, if exemptions are made for certain regulations we question whether those regulations should exist at all. We believe that the law should be applied equally and carve outs should not be made. Because of these competing principles, we remain neutral on SB 601.
