Bill Analysis

SB 452 would amend the Education and Government Codes to add that an institution or governmental entity awarding a public work contract funded by state money, including debt guaranteed by the state, may not prohibit, require, discourage, or encourage the bidder from entering or adhering to an agreement with a collective bargaining organization.

Vote Recommendation Notes

This bill enhances our limited government principle by not allowing the government to force a bidder for a public works contract to work with or not work with a collective bargaining organization. This would help to keep government from using public contracting to advocate a political agenda in support of or in opposition to collective bargaining. Government contracting should be awarded based on the successful bidder's ability to perform the work at hand with a view toward protecting taxpayers from overspending, not as a tool to advance a political agenda. For maintaining limited government in this manner, we support SB 452.
