Bill Analysis
SB 451 would amend the Local Government Code to add that a municipality or county may adopt or enforce a local law that specifically regulates property used as a short-term
rental only if the local law’s primary purpose is to protect the
public’s health and safety. A law may not be adopted that prohibits the use of a property as a short-term rental, regulates the marketplace, or charges the owner a tax or fee.
Vote Recommendation Notes
This bill enhances our free market and limited government principles by decreasing the severity of burdensome regulations on property rentals by local governments. We support SB 451.
