Under current law, certain private organizations that spend or are supported in whole or in part by public funds are subject to the Public Information Act and may be required to produce information pursuant to that act.
SB 408 would specify the circumstances under which, and extent to which, information maintained by such a private entity is subject to disclosure under the Public Information Act. The intent is to ensure that private organizations which spend significant amounts of public funds, are largely supported by public funds, or which contract to perform services traditionally performed by the government are required to comply with Public Information Act requests regarding their use of public funds..
SB 408 strikes a delicate balance between ensuring transparency in public spending (a necessary feature of limited government) and protecting private entities from having to disclose private or proprietary information unrelated to the expenditure of public funds. For these reasons we support SB 408.
