Relating to the prosecution of the offense of improper sexual activity with a person under supervision. 

Bill Analysis

Under current law improper sexual activity between an employee of a Texas corrections department and a person in custody, is considered a violation of civil rights and the employee subject to penalty. This bill would include employees of a community supervision and corrections department and those who volunteer at a juvenile facility or juvenile probation department among those subject to a penalty if they engage in improper sexual activity with a person in the custody or under the supervision of the department.

Vote Recommendation Notes

This bill supports our liberty principle of personal responsibility. Public officials are entrusted to protect the life, liberty, and property of Texans, and they violate this trust when they commit inappropriate sexual acts with persons under their custody. Employees of a community supervision and corrections department must also be held accountable if they violate someone's rights. We support SB 343.
