The adoption process is regulated by the state and the state has an obligation to ensure that the rights of the birth parents, adoptive parents, and adopted children are protected. We support efforts in this legislation to make it easier for adults who were adopted as children to obtain their vital records, particularly medical history information. We are concerned, however, that this legislation does not adequately protect the rights of birth parents who wish to remain anonymous. Birth parents who choose closed adoptions for the purpose of remaining anonymous certainly should have some expectation of having that stipulation honored. For these reasons we remain neutral on SB 329.
