Bill Analysis

This bill would clarify the proper scope of the process under which a lis pendens could be expunged. The modification to this portion of the code serves to expand the applicability that was originally intended when the legislature authorized this process in 2009. This bill would also clarify that when a notice of lis pendens is expunged, the transfer of real property would not be encumbered.
