Bill Analysis

This bill would establish a permitting program specifically for intermodal shipping containers. The permit would be an annual permit with a weight allowance of up to 93,000 pounds and cost $2,000. Of the fees collected, 90 percent would be deposited to the state highway fund, 5 percent to the Texas DMV fund, and 5 percent to the county road and bridge fund.

It would also establish certain route restrictions and manners in which the fee revenue can be used. 

Vote Recommendation Notes

Though it would make more sense to simple establish a permitting program for commercial vehicles solely upon weight, making it a more equitable system for all, it is well within the authority of the state to determine what fees and permits are necessary as a result of commercial vehicles using public roads. 

For this reason, we remain neutral on SB 1939.
