Bill Caption
Relating to the applicability of certain laws to open-enrollment
charter schools.
Fiscal Notes
No significant fiscal implication to the State is anticipated.
Bill Analysis
This bill would have open enrollment charter schools be considered school districts for the purposes of zoning. Charter schools would also not have to pay impact fees unless the board of trustees of the district or the governing body
of the charter school consents to the payment of the fees by
entering a contract with the political subdivision that imposes the
fees.
Vote Recommendation Notes
SB 1838 would ensure that open enrollment charters are treated fairly when it comes to zoning requirements; just as school districts are treated. For this reason, we support this bill.
