Bill Caption

Relating to an enhanced penalty for repeated criminal trespass on or in the property of a public institution of higher education.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

This bill would enhance penalties for the act of repeated criminal trespass on institutions of higher learning. If it is shown at trial that an individual has previously been convicted, or received deferred adjudication, as a result of criminal trespass on an institution of higher learning, they would face a Class A misdemeanor charge. That crime is currently considered a Class B misdemeanor.

Vote Recommendation Notes

In general we oppose legislation that carries penalty enhancements, however in this instance the issue sought to be addressed is a legitimate one and it is within the authority of the legislature to determine appropriate penalties. Therefore, we remain neutral.
