Bill Caption
Relating to the amount of an administrative penalty assessed
against freestanding emergency medical care facilities.
Fiscal Notes
From the LBB: No significant fiscal implication to the State is anticipated.
Bill Analysis
This bill would change the administrative penalty assessed against freestanding emergency medical care facilities to not more than $25,000 in total. Each day a violation continues or occurs would be a separate violation, but the total amount would not be able to exceed $25,000. This is a change from current law, which sets the limit at $5,000.
Vote Recommendation Notes
This bill violates our limited government principle by significantly raising the ceiling of administrative penalties that may be imposed on a private business. For this reason we oppose SB 1592.
