Bill Analysis
Under current law, a county or municipality is authorized to create regulations and zoning rules for manufactured and mobile home communities. SB 1248 would prohibit a county or municipality from requiring a change of use of nonconforming land if the nonconformity is authorized by law and at least 50% of the manufactured homes in the community are physically occupied as a residence. In addition, this bill would prohibit a county or municipality from regulating property as a manufactured home community if the the tract contains less than four spaces offered for lease.
Vote Recommendation Notes
This bill enhances our limited government and property rights principles by restricting the authority of local governments to regulate manufactured home communities. For this reason, we support SB 1248.
