Bill Analysis

SB 1176 is a local bill that would amend the Alcoholic Beverage Code to create a water park permit to be issued to a person who holds a wine and beer retailer's permit and operates a public venue that involves water slides and is located primarily along the banks of the Comal River. The holder of two or more permits would be permitted to deliver alcoholic beverages between any premises for which the permits have been issued. Finally, a person is permitted to hold up to five permits and the fee for each one would be $30.

Vote Recommendation Notes

Although this is a bracketed bill for New Braunsfels and Schlitterbahn, it enhances our free market and limited government principles by allowing a certain facility more freedom to transport alcoholic beverages between owned facilities, making it easier to earn a living. We support SB 1176, though recommend the new permit created be abolished and these freedoms be extended to all businesses.
