Bill Analysis
This bill would allow physicians to prescribe epinephrine auto-injectors in the name of a daycare and provide a standing order for the administration of an epinephrine auto-injector to a person reasonably believed to be experiencing anaphylaxis. The bill would also make a person who administers or fails to administer an epinephrine auto-injector at a day care in good faith immune from civil or criminal liability resulting from their action or failure to act.
Vote Recommendation Notes
This bill is in keeping with our limited government and personal responsibility principles, since it allows daycare centers to have the ability to treat anaphylaxis without having to depend on a child having their own epinephrine auto-injector with them. It also would help encourage the safety of children at daycare centers by making auto-injectors available and limiting the liability of the day care and persons at the daycare. For these reasons, we support this bill.
