Bill Analysis

This bill would allow a physician, nurse, midwife, or other person in attendance at childbirth to not administer prophylaxis to an infant whose parent or guardian does not consent to prophylaxis and be free from liability for following the parents wishes. The bill would require that they ensure the objection of the parent, managing conservator, or guardian is entered into the medical record of the infant.

Vote Recommendation Notes

This bill furthers individual liberty and limited government by protecting medical professionals who follow the wishes of a parent or guardian regarding the health of the child. For this reason we support SB 1081.
