Bill Analysis
SB 1076 would amend the Insurance Code to prohibit a health plan issuer from requiring an enrollee to make a payment for a drug in amount greater than the lesser of the applicable copayment or the allowable claim for the prescription drug, or the amount an individual would pay for the drug if the individual purchased the drug without using a health benefit plan or any other source of drug benefits or discounts.
Vote Recommendation Notes
This bill violates our free market and limited government principles by mandating how much a health plan can require an enrollee to pay for prescription drugs. It is not the proper role of government to regulate the price of prescription drugs in an agreed upon private contract. For these reasons, we oppose SB 1076.
