Bill Analysis
SB 1018 would require the Department of Family and Protective Services to license a family residential center, operated by or under contract with U.S. Immigration and Customs Enforcement, in the same manner as the department licenses a general residential operation. The executive commissioner would be permitted to exempt a family residential center from any minimum standard or rule to allow family members to remain together in the same living space, a parent or family member to care for a child at the center, or operate the center.
Vote Recommendation Notes
These family residential centers are already licensed under an emergency program set up by the Department of Family Protective Services designed to comply with precedent in a federal court ruling. A state court has found the emergency licensing to be inconsistent with state law. This legislation is designed to alleviate that inconsistency so the state and the facilities can remain in compliance. For these reasons we remain neutral on this legislation.
