Bill Analysis

HB 4042 would change the title of a charitable auction permit to a temporary auction permit. This bill would also allow a person or group who are subject to certain recordkeeping requirements to be issued a permit. The TABC would be prohibited from imposing a surcharge for a temporary auction permit. Lastly, the restriction on a holder of a permit to conduct only one auction a year would be removed.

Vote Recommendation Notes

While most of this bill is changing the title of the permit throughout current code, we support the provisions in this bill which allow more individuals to obtain a license, and allow permit holders to conduct multiple auctions a year. This upholds our principles of limited government, free markets, and individual liberty, so for these reasons, we support this legislation.
