Bill Analysis
Under current law, a farmers' cooperative society incorporated under the Agricultural Code is exempted from the franchise tax. HB 3992 would clarify that this provision includes a cooperative
whose single member is a farmers’ cooperative described in certain provisions of federal code that has at least 500
farmer-fruit grower members.
Vote Recommendation Notes
While we are otherwise opposed to these franchise tax exemptions due to the market distortions they create, given the procedural nature of this bill in clarifying the application of existing law, we remain neutral on HB 3992.
