Bill Analysis

HB 3913 would amend the Government Code to require a governmental entity to include in a public works contract to which the entity is a party a provision that establishes the circumstances under which the project will be substantially complete and if retainage will be released on substantial completion of the project. Next, a governmental entity would be prohibited from withholding a retainage that exceeds 5% of the contract price on a public works contract with a total value of $1 million or more. Third, this bill would implement certain restrictions on retainage withheld by a prime contractor from a subcontractor, or by a subcontractor from another subcontractor, under public works contracts with a total value of at least $250,000.
