Relating to a motion for forensic DNA testing of certain evidence previously subjected to faulty testing.

Bill Analysis

This bill would modify the code of criminal procedure to allow certain individuals who have been convicted of a crime to apply for a writ of habeas corpus. If DNA test results from a laboratory that has since been deemed to engage in faulty testing practices was presented as evidence in a convicted person’s trial, they may be granted relief if this bill passes.

Our system of justice must protect against wrongful conviction. This bill helps in that pursuit and in so doing upholds our commitment to individual liberty.
