Bill Analysis

HB 3871 is a bill bracketed for Harris County that would make the owner of a substandard residential building to be personally liable for the payment of a substandard residential building fine. Until the fine is paid, a municipality may file a lien on the building for the amount of the fine. 

Vote Recommendation Notes

This legislation would undermine the system of business formation in which people start businesses structured in a variety of ways that include specific protections against personal liability for company. Municipalities already have avenues of recourse available to abate substandard residential buildings. Adding a new personal liability would grow the scope of government which offends our limited government principle. We oppose HB 3871.
