HB 3868 would allow a property owners' association, upon the affirmative vote of a majority of owners, to amend a dedicatory instrument to require that a tenant applicant consent to a background and criminal history check.

Vote Recommendation Notes

This bill infringes on the principles of individual liberty and personal responsibility by authorizing a property owners' association to require a tenant applicant to consent to background checks. Because this would open the door for individuals to be restricted in where they choose to live in a free society, we oppose HB 3868.
