Bill Analysis

HB 3804 would prohibit an automobile insurer from limiting coverage under a policy covering damage to a motor vehicle based on the use of a particular repair person or facility. This would also apply to settling a liability claim by a third party against an insured for property damage.

Vote Recommendation Notes

This bill violates our free market and limited government principles by prohibiting automobile insurers from using standard industry practices that help to control costs for themselves and for their customers. It is not the proper role of government to regulate the provisions of private agreements between insurance companies and their customers. For these reasons, we oppose HB 3804.
