Bill Analysis
Under current federal law, industry associations possess the authority to conduct inspection programs. HB 3707 would require the Department of Agriculture to establish a cattle inspection program to discourage and investigate property crimes upon request by the Texas and Southwestern Cattle Raisers Association and if a similar federal program is being suspended or dissolved. Special rangers would conduct inspections and assessments would be imposed against inspected private entities to cover costs. Assessments would be paid to the Cattle Raisers Association and would not be considered state funds.
Vote Recommendation Notes
While this bill only continues existing authority contingent on deauthorization under federal law, this bill infringes on the principle of limited government by authorizing the creation of an inspection program administered by a specific industry association applicable to industry participants, including non-members. Because this would use state authority to enable a private association to perform mandatory regulatory functions, we oppose HB 3707.
