Relating to the use of public-private partnerships by certain transportation authorities.

Bill Analysis

Under current law, contracts related to public and private facilities and infrastructure projects does not apply to transportation authorities created to oversee: metro authorities, regional transportation authorities, municipal transit department, coordinated county transportation authority.

HB 3252 would amend current Government Code by adding a subsection that would include transportation authorities with a principal municipality with a population greater than 1.9 million.

Vote Recommendation Notes

The authority to make changes for funding political subdivisions is clearly within the legitimate responsibility of the state government, the provisions of this bill have no relationship to our liberty principles. However, it is worth noting that exempting entities from statutory provisions that would otherwise apply to similar authorities sets up an inequitable system and can cause issues. HB 3252 neither uplifts nor offends our liberty principles, therefore we remain neutral.
