Relating to the delegation of matters to the executive director of the Texas Commission on Environmental Quality.

Bill Analysis
Under current law, certain uncontested applications or requests sent to the Texas Commission on Environmental Quality are delegated to the executive director. HB 3177 would also delegate matters that were previously contested and have become uncontested or matters for which contesting parties have agreed to allow the executive director to take action. This bill would also allow an affected individual to file a petition for judicial review regarding a decision made by the executive director. HB 3177 also clarifies that a petition may only be filed after administrative remedies have been exhausted.
