Bill Analysis

Under current law, a person who is possesses an abandoned or deteriorated well is responsible for plugging that well within 180 days of learning of its condition. HB 3025 would enable a possessor of a deteriorated well to repair it within 180 days in addition to the option of plugging the well. Procedures related to the covering of uncovered wells would also be applied to abandoned or deteriorated wells.

This bill would also explicitly authorize an employee of the Bandera County River Authority and Groundwater District to cap an open, uncovered, or abandoned well, or repair or plug a deteriorated well, if the employee has received training for such activities in a karst topographic area.
