Bill Caption

Relating to indemnification and duties of engineers and architects under certain governmental contracts.

Fiscal Notes

No significant fiscal implication to the state is anticipated.

Bill Analysis

HB 3021 would amend the Government Code to prohibit a state governmental entity from requiring a contractor to defend the state for claims or liabilities resulting from the negligent acts or omissions of the state governmental entity or its employees.

Vote Recommendation Notes

This bill enhances our limited government principle to hold the state responsible for negligent acts and omissions by the governmental entity or its employees rather than requiring contracted architects or engineers to defend the state. We support HB 3021.
