Bill Analysis
Under current law, a law enforcement officer may obtain certain information regarding a complaint made against the officer. HB 2991 would clarify that information available to the officer does not include information that is an attorney-client communication, an attorney work product, or other information protected by a privilege recognized by the Texas Rules of Civil Procedure or the Texas Rules of Evidence. The bill would also outline which information or material pertaining to an investigation file from the Texas Commission on Law Enforcement would be made confidential.

This bill enhances our limited government principle by protecting personal information in an attorney-client communication from being disclosed to a law enforcement officer following a complaint. We support HB 2991.
