Relating to reporting requirements by certain physicians and health care facilities for abortion complications; authorizing a civil penalty.

No significant fiscal implication to the State is anticipated. 

Bill Analysis

This bill would require a facility that performs abortions to submit a quarterly report to the Department of State Health Services on abortion complication diagnoses and treatment at that facility. The department would be required to post on their website an annual report that aggregates on a statewide basis each abortion complication required to be reported under the section. A violation of the section would result in a civil penalty of $500 for each violation. The third separate violation by a facility would constitute cause for revocation of a facility's license, permit, registration, certificate, or other authority. 

The House amended this bill on the floor to also make physicians responsible for reporting on abortion complications. A violation would be grounds to suspend their license and the department would be required to report violations to the Texas Medical Board.

This bill deals with what we regard primarily as a social issue. Texas Action does not make vote recommendations on social issues, therefore we remain neutral on this legislation.
