Bill Analysis

Under current law, the attorney general must bring suit upon request by the Texas Commission on Environmental Quality or the Public Utility Commission for the appointment of a receiver to collect the assets and carry on the business of a water or sewer utility that has abandoned operation or violated a final order of either commission. HB 294 would also require the attorney general to bring such a suit against a utility that violates a final judgment issued by a district court in a suit brought by the attorney general under the Water or Health and Safety Code.

Vote Recommendation Notes

This bill neither uplifts nor offends our liberty principles, particularly given that it is procedural in nature. For this reason, we are neutral on HB 294.
