Relating to the imposition of additional fees for filing civil cases in Willacy County and Starr County.

Bill Analysis

This bill would authorize the clerk of a court in Willacy County and Starr County to collect a filing fee of not more than $20 in civil cases. The proceeds would be deposited into a special account in the county treasury, and would used for the construction, renovation, or improvement of the facilities that house Willacy County civil courts. It may also be used to pay the principal and interest of bonds issued for the construction, renovation, or improvement of these civil courts. This bill also authorizes a procedure for a commissioner’s court to adopt or rescind resolutions related to the collection and use of these funds, and all fees authorized by this legislation would expire in October of 2045. However, the county would be able to make expenditures out of the special account at any time.

Vote Recommendation Notes

This bill is local in nature, permissive, and allows a user fee mechanism for the specified counties to improve their civil court facilities. This does not affect our liberty principles and we remain neutral.
