Relating to the placement of certain substances in Penalty Groups 1 and 3 of the Texas Controlled Substances Act for the purposes of prosecution of criminal offenses involving those substances.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

This bill would add certain additional illicit substances to Penalty Groups 1 and 3.

Vote Recommendation Notes

On one hand, we are opposed to the overcriminalization of nonviolent drug users which is why we are in support of drug diversion courts. On the other hand, we realize that these drugs are addiction inducing and potentially deadly and that not everyone in possession of these substances is merely a nonviolent user. This bill has an equal an opposite effect on our principles therefore we will remain neutral.
