Bill Analysis
This bill would limit the situations under which a court may award an individual attorney’s fees in various suites against the state. If this bill passes, and if someone is seeking legal or equitable relief relating to the applicability, assessment, collection, constitutionality, or amount of a tax or fee imposed under the enforcement and collection portion of the Texas Tax code, they would not be allowed to be awarded attorney’s fees.

This bill violates our commitment to limited government by interfering with the rule of law. If someone was wronged and was forced to hire an attorney to correct the injustice, they should be eligible for at least reasonable attorney’s fees if they win the suite. The double standard this bill creates is an offense against justice, because justice applied non-uniformly is not justice at all. For this reason we oppose this bill.
