Bill Analysis

HB 2662 would require the Texas Commission on Environmental Quality to complete a study at least every four years on the available volume and curie capacity of the Texas Low-Level Radioactive Waste Disposal compact waste disposal facility.

HB 2662 would reduce the state surcharge for the disposal of nonparty compact waste from 20 to 10 percent of the total contracted rate for a limited time. This bill would also require a compact waste disposal facility license holder to transmit five percent of certain gross receipts to the state general revenue. In addition, HB 2662 would create a legislative oversight committee to make recommendations regarding fixed costs, disposal fees, the contingency plan, and the effects of certain fees and surcharges.

The Texas Compact Waste Facility is owned and licensed by the state of Texas and operated by Waste Control Specialists, LLC. It is the only commercial facility in the United States licensed to dispose of Class A, B and C Low-level Radioactive Waste in the past 40 years.

This bill simultaneously uplifts and offends the principle of limited government by reducing a state surcharge and requiring a private business to transmit an amount of gross receipts to state revenue.

Due to the limited application of this bill and the conflicting liberty principles, we remain neutral on HB 2662.
