Relating to the personal liability of certain elected officials under local government programs to fund water and energy savings improvements through assessments.
Fiscal Notes
No significant fiscal implication to the state is anticipated.
Bill Analysis
Under current law, the governing body of a local government
may contract with the governing body of another taxing unit or entity,
including a county assessor-collector, to perform collections of certain assessments
imposed by the local government. HB 2654 would add that a county
assessor-collector who performs these duties is not personally liable as a
result of exercising those duties.
Vote Recommendation Notes
This bill enhances our individual liberty principle by protecting a person from personal liability for simply carrying out their lawful duties as a public official. For this reason we support this bill.
