Relating to the authority of a city attorney to seek an injunction to abate a common nuisance under the Alcoholic Beverage Code.

No significant fiscal implication to the state is anticipated.

Bill Analysis

Current law allows the county attorney or district attorney in a county where a common nuisance exists to sue in the name of the state to abate the nuisance. The attorney general may also sue on behalf of the state to achieve these same ends.

HB 256 would allow the city attorney in the city where a common nuisance exists to sue in the name of the city for an injunction to abate it.
