Bill Caption
Relating to confidentiality of reports and related information for a solvency examination of an insurance carrier.
Fiscal Notes
No significant fiscal implication to the state is anticipated.
Bill Analysis
HB 2437 would amend the Insurance Code to add that a final or preliminary examination report and any information obtained during a solvency examination are confidential and privileged for all purposes and not subject to a subpoena, other than a grand jury subpoena, or discovery or admissibility in evidence in a civil action.
Vote Recommendation Notes
This bill would protect the property rights of an insurance company that was the subject of a solvency report by preventing their private confidential information from being made available to their competitors. For this reason we support HB 2437.
