Bill Analysis
HB 2435 would:
- expand the definition of a public improvement project to include recreational facilities and certain water features;
- exempt public improvement projects partially funded by special assessments;
- authorize the acquisition of right-of-ways for public improvement projects;
- authorize payment of expenses related to the operation and maintenance of public improvement projects;
- remove a right to protest certain project funded through general obligation or revenue bonds;
- allow for the public hearing and decision process for increasing the area of a public improvement project. Subsequently, the governing body can make a reassessment of the new land;
- use the Special Improvement District Fund to pay for the initial cost of general obligation or revenue bonds, while improvement bonds would no longer be covered; and
- allow a municipality to pledge undedicated tax increment revenue for the payment of obligations.
Vote Recommendation Notes
We do not believe the that the use of public improvement districts in this way is the proper role of government therefore we oppose this bill.
