Bill Analysis

Under current law, procedures are instituted for the investigation of firefighters and police officers by an investigator. HB 2351 would allow emergency services districts and municipalities to conduct investigations on firefighters. A municipality and an emergency services district may not take punitive action against a fire fighter unless an investigation has been conducted in substantial compliance with existing statutory regulations in Local Government Code pertaining to investigations of police officers and fire fighters.

Vote Recommendation Notes

This bill on the one hand would protect certain fire fighters from punitive action, it may also diminish limited government by making it unnecessarily difficult for leadership to discipline fire fighters. For these reasons we remain neutral.
