Relating to the imposition of a criminal penalty for the violation of a rule adopted or order issued under the Flood Control and Insurance Act in certain counties.

No fiscal implication to the State is anticipated.

Bill Analysis

Under current law, a direct violation of the Flood Control and Insurance Act is considered a criminal offense. HB 2334 would also apply these criminal offenses to violations of rules and orders adopted under the Flood Control and Insurance Act. An offense would be a Class C misdemeanor.

Vote Recommendation Notes

One of the ways government has grown too big and powerful is through the growth of the administrative state. When people other than elected legislators make criminal law through the bureaucratic rulemaking process, liberty is diminished even if in this case only at the level of a Class C misdemeanor. For perpetuating the growth of the administrative state at the expense of liberty, we oppose HB 2334.
