Relating to the sale of malt liquor, ale, and beer by the holder of a brewpub license.

Bill Analysis

Current law allows a holder of a brewpub license who also holds a wine and beer retailers permit to sell beer, malt liquor, and ale produced under the license on the brewpub premises to other retailers.

HB 2097 would clarify that the holder of a brewpub license who also holds a wine and beer retailer's permit and "whose sale of beer, ale, or malt liquor consists only of beer, ale, or malt liquor manufactured on the brewpub's premises" may sell those products to other specific types of retailers specified in statute. 

Vote Recommendation Notes

This legislation cleans up this section of code by making it more specific. The changes proposed by HB 2097 appear to be consistent with the intent of current statute and do not appear to significantly alter the level of government regulation of this industry. For these reasons we remain neutral on HB 2097.
