Bill Analysis
HB 2089 would allow judges to grant deferred adjudication community supervision to certain offenders who, currently, are prohibited from receiving that sentence. Driving, boating, flying, and setting up/running amusement park rides while intoxicated would be ineligible for deferred adjudication community supervision only under certain circumstances. A judge who grants deferred adjudication community supervision under the provisions of this bill would be compelled to require an ignition interlock device as a condition of their community supervision.
In addition, if this bill passes, a person who is driving while intoxicated with a child passenger would be subject to an enhanced sentence of a third-degree felony in certain situations.
