Bill Analysis

Under current law, construction contracts that are principally for the construction or repair of an improvement to real property are under certain provisions concerning voidable contracts when there is a conflict subject to another state’s law. HB 1844 would broaden this provision to include more contracts and agreements that are subject to another state’s law. In addition, this bill would make it so that the party with the authority to void a contract or agreement provision is the party obligated to perform the work outlined in the construction contract.

Vote Recommendation Notes

Given the procedural nature of this bill, HB 1844 neither uplifts nor offends our liberty principles, therefore we remain neutral.
